These Terms of Service (“Terms”) constitute a binding legal agreement between you and Big Bag Ventures, Inc., operator of the ModelArea platform (“ModelArea,” “we,” “us,” or “our”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you are not authorized to use the Service.

We may amend these Terms at our discretion. The revised Terms become effective upon posting. Your continued use of the Service after publication of changes constitutes acceptance of the revised Terms.

ModelArea indexes, organizes, and displays information relating to digital creators, including publicly available data and user-submitted materials. We may modify, suspend, or discontinue any part of the Service at any time without notice or liability.

We do not guarantee the accuracy, completeness, or reliability of any content. Information may be incomplete, outdated, or supplied by third parties beyond our control.

You must be at least eighteen (18) years old and legally competent to contract to use the Service. By creating an account, you represent that the information you provide is truthful and accurate. You are solely responsible for all activities conducted under your account credentials. You must safeguard your login information and notify us immediately of any unauthorized use or security breach.

We reserve the right to request identity verification in connection with account creation, profile claims, or rights-based complaints. Failure to provide satisfactory verification may result in suspension or denial of access.

If you submit, upload, or otherwise provide content to the Service (“User Content”), you grant ModelArea a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, distribute, and adapt such content as reasonably necessary to operate and improve the Service.

You represent and warrant that you own or control all necessary rights to your User Content and that its use does not infringe or misappropriate any third-party rights or violate applicable law. You remain solely responsible for your User Content.

The Service may display profiles and information collected from public sources. We do not claim ownership of such materials and disclaim responsibility for their accuracy. If you are the subject of a profile, you may request modification or removal by following the procedures on our DMCA and Rights page. We may require identity verification before acting on such requests.

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:

• Accessing or using the Service in violation of any law or regulation.
• Scraping, crawling, harvesting, or exporting data without prior written authorization.
• Bypassing technical protections, rate limits, or security features.
• Uploading viruses, malware, or harmful code.
• Using the Service to harass, stalk, or unlawfully disclose personal information.
• Reverse engineering or attempting to derive source code, except where expressly permitted by law.

All rights, title, and interest in the Service, including software, databases, design, and trademarks, are owned by ModelArea.com or its licensors. Except for limited rights expressly granted herein, no license or right is conveyed to you. Unauthorized use of our intellectual property is strictly prohibited.

Copyright complaints must follow our DMCA Policy. For other rights-based claims, including defamation, trademark, or privacy, you must provide written notice to legal@modelarea.com with sufficient detail for us to evaluate the claim. We reserve discretion to remove, restrict, or decline to act on disputed content.

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, revenues, or data. Our aggregate liability for any claim shall not exceed the greater of one hundred dollars ($100) or the amount you paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless ModelArea.com its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of or related to your use of the Service, your User Content, or your breach of these Terms.

Any dispute, claim, or controversy arising out of or relating to the Service shall be resolved by binding arbitration, administered under the rules of the American Arbitration Association. Proceedings shall be conducted on an individual basis; class actions and collective proceedings are prohibited. Either party may seek injunctive relief in court to protect intellectual property rights.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Venue for any permitted court proceedings lies exclusively in Orange County, California.

These Terms constitute the entire agreement between you and us. If any provision is held unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Failure to enforce any provision shall not constitute a waiver.
