How to Send a DMCA Notice
If you believe content on ModelArea infringes your copyright, send a written notice that includes all items below.
- Your physical or electronic signature.
- Identification of the copyrighted work you claim is infringed. You may list multiple works in one notice.
- Identification of the material you claim is infringing or the subject of infringing activity. Include the URL on ModelArea or other specific location information that allows us to find the material.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
We may forward your notice to the user who posted the material.
How to Send a Counter Notification
If your material was removed due to a DMCA notice and you believe it was removed in error, you may send a counter notification. Include all items below.
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled. Include the URL on ModelArea.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are outside the United States, for any judicial district in which ModelArea may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.
When we receive a valid counter notification, we may restore the material unless the original claimant notifies us that they have filed an action seeking a court order to restrain you from engaging in infringing activity. Restoration may take ten to fourteen business days after we forward the counter notification.
Repeat Infringer Policy
We may terminate accounts of users who are repeat infringers. We also handle one off violations in our discretion.
Standard Technical Measures
We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect works, consistent with the DMCA.
Misrepresentation
Knowingly submitting false notices or counter notifications may expose you to liability for damages under 17 U.S.C. § 512(f).
